Terms and Conditions for Waste Collection Shepherds Bush
These Terms and Conditions set out the basis on which we provide waste collection services in and around Shepherds Bush. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions and Interpretation
In these Terms and Conditions, the following definitions apply:
Customer means the individual or business who requests or receives the waste collection service.

2. Scope of Service
We provide scheduled and ad hoc waste collection services for domestic and commercial customers. The nature, size and frequency of the collection will be as set out in your booking confirmation.
Our Service is generally limited to non-hazardous waste. We may agree to collect specific items such as electrical waste, green waste or construction debris, subject to additional charges and compliance with relevant regulations. These details will be confirmed at the time of booking.

3. Booking Process

Your booking is an offer to purchase Services from us. The Contract between you and us is formed only when we issue a booking confirmation stating the agreed date, approximate collection time window, service description and price estimate or fixed fee.
You must ensure that all information you provide is complete and correct. If, upon arrival, we find that the waste differs significantly in type or quantity from what was described, we may adjust the price, amend the Service, or refuse to carry out the collection.
Any estimated collection time provided is an indication only. While we aim to attend within the stated time window, we do not guarantee exact arrival times. We will use reasonable endeavours to notify you of any significant delays or necessary changes to the booking.
4. Access and Customer Responsibilities
You are responsible for ensuring safe and reasonable access to the collection point at the agreed time. This includes arranging any necessary permissions for access, such as entry to communal areas, car parks or private land, where applicable.
Waste must be presented in a manner that allows safe loading and handling. Where appropriate, waste should be bagged, boxed or securely contained. Heavy or bulky items should be clearly identified, and any sharp or dangerous objects must be safely packaged.
You must not present for collection any prohibited or restricted items, including but not limited to hazardous substances, clinical or medical waste, asbestos, gas cylinders, explosives, solvents, oils, chemicals or any other materials classified as hazardous under applicable UK legislation, unless we have expressly agreed in writing to collect them in accordance with the relevant regulations.
If access is not available at the agreed time, or if the waste is not presented as required, we may charge a call-out fee or treat the booking as cancelled by you. In these circumstances, our standard cancellation terms will apply.
5. Pricing and Payment
Prices for waste collection services are based on factors including waste type, volume, weight, ease of access, loading time, and any local disposal charges. We will provide either a fixed price or an estimate at the time of booking.
Where we provide an estimate, the final price may vary if the actual waste type or volume differs from the description given, or if additional work is required. Any changes to the price will be discussed with you before we proceed.
Payment terms will be confirmed in your booking. We may require full payment in advance, a deposit, or payment upon completion of the Service. We accept common methods of payment such as card or bank transfer, as specified at the time of booking.
All prices are quoted in pounds sterling and, where applicable, include any value added tax at the prevailing rate, unless otherwise stated. You are responsible for all charges associated with your chosen payment method.
If payment is not received in accordance with the agreed terms, we reserve the right to suspend Services, charge interest on overdue amounts at the statutory rate, and recover any reasonable costs incurred in collecting the debt.
6. Cancellations and Changes
You may cancel or amend your booking by contacting us directly. Any cancellation or change must be confirmed by us to be effective.
If you cancel more than 24 hours before the scheduled collection time, we will ordinarily refund any pre-paid amount, less any reasonable administrative costs, unless we have incurred specific expenses that cannot be recovered.
If you cancel within 24 hours of the scheduled collection time, arrive late, or fail to provide access, we reserve the right to charge a cancellation fee up to the full amount of the agreed service price. This reflects the costs associated with allocating a vehicle and crew for your booking.
We may need to reschedule or cancel a booking due to circumstances beyond our reasonable control, such as severe weather, vehicle breakdown, road closures or staff illness. In such cases, we will offer an alternative date and time as soon as reasonably practicable. Our liability in these circumstances will be limited to rescheduling the Service or refunding any amount paid for the affected booking.
7. Waste Regulations and Duty of Care
We operate in accordance with applicable UK waste management legislation, guidance and codes of practice. This includes compliance with the duty of care requirements relating to the storage, transport and disposal of controlled waste.
By using our Service, you confirm that you are the owner of the waste or that you have the authority of the owner to arrange for its collection and disposal. You must not present for collection waste that has been illegally deposited or fly-tipped unless you have full authority to arrange its lawful removal.
We will transport collected waste only to authorised facilities or transfer stations that are appropriately licensed or permitted. We will take all reasonable steps to ensure that waste is handled and processed in accordance with environmental regulations, including recycling where practicable.
Where required, we will provide or complete documentation such as waste transfer notes, detailing the nature and destination of the waste. You agree to provide any information reasonably necessary for us to comply with these regulatory obligations.
We reserve the right to refuse or suspend the Service if we reasonably suspect that accepting the waste would breach any legal or regulatory requirement.
8. Liability and Limitations
We will exercise reasonable skill and care in providing the Service. However, our liability to you is limited as set out in this section.
We are not liable for any loss or damage arising from inaccurate or incomplete information you provide, including incorrect descriptions of waste, access restrictions, or contact details. We are also not liable for any loss caused by your failure to comply with your responsibilities under these Terms and Conditions.
We will take reasonable care when collecting and removing waste from your premises. Nevertheless, we are not responsible for pre-existing damage or for damage caused by the inherent nature of the waste or the condition of the premises, such as fragile surfaces, poorly constructed access routes or hidden defects.
If we are found liable to you, our total liability for any single incident or series of connected incidents will, to the extent permitted by law, be limited to the amount you have paid for the specific Service giving rise to the claim.
We are not liable for any loss of profit, business interruption, loss of data, loss of reputation, or any indirect or consequential loss, whether arising in contract, tort or otherwise, unless such loss cannot be excluded under applicable law.
Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under UK law.
9. Customer Indemnity
You agree to indemnify us against any claims, losses, damages, costs and expenses arising from:
your breach of these Terms and Conditions;
your provision of waste that is hazardous, prohibited or misdescribed; or
any claim brought by a third party arising out of or in connection with the waste collected from your premises, except to the extent that such claim results from our negligence or breach of statutory duty.
10. Complaints and Service Issues
If you are dissatisfied with any aspect of our Service, you should notify us as soon as possible, providing your booking reference and details of the issue.
We will investigate complaints in a fair and timely manner and may request additional information or photographs to help us assess the situation. Where appropriate, we may offer a remedy such as a partial refund, re-attendance, or other corrective action.
Raising a complaint does not entitle you to withhold payment, except where we expressly agree in writing to suspend payment obligations pending resolution.
11. Data Protection and Privacy
We collect and process personal information such as names, contact details, addresses and payment information in order to provide the Service, manage bookings and comply with legal obligations.
We will handle your personal data in accordance with applicable UK data protection laws. We will use your information only for legitimate business purposes, including providing the Service, handling enquiries, processing payments, and keeping appropriate records.

14. General Provisions
If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable, that provision will be deemed deleted, but this will not affect the validity and enforceability of the remaining provisions.
No failure or delay by us in exercising any right or remedy under these Terms and Conditions will constitute a waiver of that or any other right or remedy.
You may not assign or transfer any of your rights or obligations under the Contract without our prior written consent. We may assign or subcontract our rights and obligations, provided that this does not materially affect the standard of the Service.
